TERMS AND CONDITIONS OF SALE – BLUSONARY

These Terms and Conditions govern the sale of products through the BLUSONARY website (the “Site”) and the use of related services (the “Services”).

By accessing the Site or placing an order, you agree to be bound by these Terms.

2. ELIGIBILITY

By placing an order, you confirm that:

  • you are at least 18 years old, or legally capable of entering binding contracts

  • the information you provide is accurate and complete

3. PRODUCTS

We make every effort to display product descriptions, images, colors, and details accurately.

However:

  • colors may vary depending on screen settings

  • minor variations in materials or finishing may occur

  • product availability is not guaranteed until order confirmation

We reserve the right to modify or discontinue products at any time.

4. PRICES AND CURRENCY

Prices are shown on the Site in the selected currency and may include or exclude taxes depending on the shipping destination.

  • Shipping costs are calculated at checkout

  • Customs duties or import taxes (for non-EU countries) are the responsibility of the customer

We reserve the right to change prices at any time, but confirmed orders will not be affected.

5. ORDER PROCESS

An order is considered an offer to purchase.

After placing an order:

  1. You receive an automatic confirmation email

  2. The contract is concluded only when we accept the order and ship the product

We may refuse or cancel orders in cases including:

  • payment authorization failure

  • suspected fraud

  • pricing or system errors

  • product unavailability

If payment was already charged, it will be refunded.

6. PAYMENT

We accept payment methods shown at checkout, which may include:

  • credit/debit cards

  • PayPal or other digital wallets

  • Shopify Payments

Payments are processed securely through certified providers.

We do not store full payment card details.

7. SHIPPING AND DELIVERY

We ship worldwide.

Delivery times:

  • EU: typically 2–7 business days

  • International: typically 5–15 business days

Times are estimates and not guaranteed.

We are not responsible for delays caused by:

  • customs procedures

  • courier disruptions

  • incorrect delivery information provided by the customer

Risk transfers to the customer upon delivery.

8. RIGHT OF WITHDRAWAL (EU CUSTOMERS)

If you are a consumer located in the European Union, you have the right to withdraw from the purchase within 14 days of receiving the goods, without providing a reason.

To exercise the right of withdrawal:

Conditions:

  • items must be unused

  • in original packaging

  • with tags intact

Refunds:

  • issued within 14 days after receiving the returned goods

  • using the original payment method

Return shipping costs are borne by the customer unless the item is defective or incorrect.

9. RETURNS FOR DEFECTIVE OR NON-CONFORMING GOODS

Consumers are entitled to the legal guarantee of conformity under EU law.

If a product is defective or not as described, contact us and we will:

  • repair or replace the item, or

  • issue a refund where appropriate

10. INTELLECTUAL PROPERTY

All Site content, including:

  • trademarks

  • logos

  • designs

  • images

  • text

  • product names

  • graphics

are the property of ICONICO 5.0 S.R.L. or licensed to it.

No content may be copied, reproduced, distributed, or used without written permission.

11. USER CONDUCT

You agree not to:

  • misuse the Site

  • attempt unauthorized access

  • interfere with system security

  • use the Site for unlawful purposes

We may suspend access if violations occur.

12. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

  • the Site and Services are provided “as is”

  • we are not liable for indirect or consequential damages

  • liability is limited to the amount paid for the purchased product

Nothing in these Terms excludes liability where exclusion is unlawful.

13. PRIVACY

Personal data is processed according to our:

14. FORCE MAJEURE

We are not liable for failure or delay caused by events beyond our reasonable control, including:

  • natural disasters

  • strikes

  • supply chain disruptions

  • government actions

  • network failures

15. GOVERNING LAW AND JURISDICTION

These Terms are governed by Italian law.

If you are a consumer resident in the EU, you may bring proceedings:

  • in your country of residence, or

  • in Italy

For non-consumer disputes, the court of Bergamo, Italy shall have exclusive jurisdiction.

16. ONLINE DISPUTE RESOLUTION (EU)

Consumers in the EU may use the European Commission Online Dispute Resolution platform:

17. CHANGES TO THESE TERMS

We may update these Terms from time to time.

The updated version will be posted on this page with a revised date.
